Boarding a vessel with intention to commit an offense is a third-degree felony and carries a maximum penalty of five years in prison and/or a $5,000 fine. The lesser charge is First-degree trespass of a vessel occupied and is punishable by up to a year in jail and/or a $1,000 fine. And that is the nice way this could have ended, why i say that? Because I almost positive (IANAL warning) that Castle Doctrine also applies to vessels and used of deadly force is legal.
This charter “captain” was lucky he encountered a young, unarmed fisherman and not a saltier Floridian who knows you don’t go into the water without the proper means to repeal boarders and tell gators to go away.
